By accessing or using the BoxyPal website (boxypal.com) or purchasing our products, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Pre-Order Deposits

By placing a pre-order deposit, you are reserving a BoxyPal device from our initial production batch. A deposit is not a final purchase — it secures your place in line and will be applied toward the final retail price of the device.

Pre-order deposits are refundable upon request. Refunds will be issued to the original payment method. Please note that third-party payment processing fees are non-recoverable and may be deducted from your refund amount.

We reserve the right to modify the final retail price, features, or specifications of the BoxyPal device prior to shipment. If material changes are made, deposit holders will be notified and given the option to receive a full refund.

3. Subscription Service

BoxyPal requires an active monthly subscription to operate. The subscription covers the AI voice service, software updates, and ongoing support. Subscription pricing will be communicated to deposit holders before shipment, and you are not obligated to subscribe if the pricing does not meet your expectations — in which case your deposit will be fully refunded.

You may cancel your subscription at any time. Upon cancellation, the BoxyPal device will no longer function as a voice companion but will remain your property.

4. Shipping

We ship within the United States and internationally. International orders may incur additional shipping fees, customs duties, and import taxes, which are the responsibility of the buyer.

Estimated shipping dates are provided in good faith but are not guaranteed. We will notify you of any significant delays.

BoxyPal processes voice conversations using third-party AI services. Conversations are streamed in real-time and are not permanently stored by BoxyPal. We are not responsible for the content or accuracy of AI-generated responses. BoxyPal is not a substitute for professional medical, legal, financial, or emergency services.

7. Intellectual Property

All content on the BoxyPal website, including text, graphics, logos, and software, is the property of BoxyPal and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any content without our written permission.

8. Limitation of Liability

BoxyPal is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet your specific requirements. To the maximum extent permitted by law, BoxyPal shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the product or service.

BoxyPal is a conversational AI companion and is not intended to provide medical advice, emergency assistance, or professional services of any kind. If your loved one is experiencing a medical emergency, please contact 911 or your local emergency services immediately.

We may update these Terms of Service from time to time. Material changes will be communicated to registered users via email. Continued use of our website or services after changes constitutes acceptance of the updated terms.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

12. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the use of BoxyPal products and services shall first be resolved through good-faith mediation. Mediation shall be conducted in Miami-Dade County, Florida, by a mutually agreed-upon mediator. If the parties cannot agree on a mediator, one shall be appointed by the American Arbitration Association (AAA).

Each party shall bear its own costs of mediation, and the mediator's fees shall be shared equally. No party may commence a court proceeding relating to any dispute until mediation has been attempted and concluded. If mediation is unsuccessful, either party may pursue resolution through binding arbitration in Miami-Dade County, Florida, under the rules of the AAA.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or any other representative proceeding.
